These Terms of Service ("Terms") are entered into by and between you ("User," "you," or "your") and Joshua Hills Nutrition LTD ("Company," "we," "our," or "us"). These Terms govern your access to and use of the Joshua Hills Academy mobile application and the website at www.joshuahillsnutrition.com (collectively, the "Service"), including any content, functionality, and services offered on or through the Service, whether as a guest or registered user.

 

Acceptance of the Terms of Service

Please read these Terms carefully before using the Service. By accessing or using the Service or by clicking to accept or agree to the Terms when this option is presented to you, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms or the Privacy Policy, you must not access or use the Service.

This Service is offered to users aged 18 and over. By using the Service, you confirm that you meet this requirement.

We may revise and update these Terms at our sole discretion. All changes are effective immediately when posted and apply to all access and use of the Service thereafter.

Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes. We recommend reviewing this page periodically to remain informed of any updates.

We reserve the right to withdraw or amend the Service, including any content, features, or functionality, at our sole discretion and without prior notice.

You are responsible for:

  1. Making all arrangements necessary for access to the Service.
  2. Ensuring that anyone accessing the Service through your internet connection complies with these Terms.

To access certain features of the Service, you may be required to create an account and provide accurate, current, and complete information. Your account details are personal to you, and you must not share them with others.

You agree to notify us immediately of any unauthorised use of your account or any other breach of security. We reserve the right to disable your account at any time if you violate these Terms.

 

Use of the Service

Permitted Use

You are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use the Service strictly in accordance with these Terms.

You must not:

  • Use the Service for unlawful purposes or in violation of applicable laws and regulations.
  • Modify, reproduce, distribute, publicly display, or create derivative works based on the Service or its content without prior written consent from the Company.
  • Access the Service through automated means (e.g., robots or spiders).

Prohibited Use

You agree not to:

  1. Upload or distribute viruses, malware, or harmful code.
  2. Attempt to interfere with the proper functioning of the Service.
  3. Use the Service in any manner that infringes on the rights of others, including intellectual property rights.

 

Payment and Subscription Terms

Subscription Plans

  • The Service offers various subscription plans. Fees and features for each plan are detailed during the sign-up process.
  • Subscriptions are billed on a recurring basis (e.g., monthly or annually) depending on the plan you select.

Renewals and Cancellations

  • Subscriptions automatically renew at the end of each billing period unless cancelled.
  • To avoid being charged for the next billing cycle, you must cancel your subscription or email [email protected] at least 24 hours before your next payment is due. Please note that social media inboxes are not managed frequently, and therefore membership queries and cancellation requests must go via the support email only. Any requests via social media will not be actioned. 
  • If cancellation is not made within this time frame, the payment for the next billing cycle will be processed.

Refunds

  • Refunds are available under our 7-Day Money-Back Guarantee for first-time users who cancel within seven days of their initial subscription purchase.
  • Refunds for other circumstances are evaluated on a case-by-case basis and at the Company's sole discretion.
  • Refunds will be processed within five (5) working days of approval.
  • Refunds should be received within 14 days of processing. If you do not receive your refund within this timeframe, please contact your bank to verify the transaction status.

 

Promotions

Promotions offered through the Service may have specific rules distinct from these Terms.

  • Please review any applicable promotion rules and our Privacy Policy before participating.
  • If there is a conflict between promotion rules and these Terms, the promotion rules will apply.

 

Health and Fitness Disclaimer

Nutrition Guidance

  • Our nutritionists are qualified as Associate Nutritionists (ANutr) or Registered Nutritionists (RNutr) and hold a degree-level education from recognised UK institutions.
  • The nutrition guidance provided, including calorie and macronutrient recommendations, is tailored to you based on the information you provide.
  • While we strive to offer professional and evidence-based guidance, we do not guarantee that the recipes or meal plans available on Joshua Hills Academy will suit your specific dietary requirements. It is your responsibility to verify packaging, labels, and allergen information for all ingredients.
  • You must consult with a qualified healthcare provider to confirm that any calorie or macronutrient advice provided is appropriate for your individual health needs.

 

Fitness Plans

General Disclaimer
The fitness plans, exercises, and advice available through Joshua Hills Academy are intended for informational and general guidance purposes only. These resources are not a substitute for professional medical advice, diagnosis, or treatment.

Individual Responsibility
By participating in the fitness programmes offered, you acknowledge that you do so voluntarily and at your own risk. You must consult with a qualified healthcare professional before starting a new fitness programme or making significant changes to an existing one.

Assumption of Risk
Engaging in physical exercise carries inherent risks. By using the fitness plans provided, you assume full responsibility for any risks, injuries, or damages that may occur as a result.

Limitation of Liability
Joshua Hills Academy shall not be held liable for any injuries, damages, or losses resulting from the use or misuse of the fitness plans, exercises, or advice offered. You agree to release, indemnify, and hold harmless Joshua Hills Nutrition LTD and its affiliates from any claims or liabilities arising from your participation.

No Warranties
We make no guarantees or warranties, expressed or implied, regarding the accuracy, reliability, completeness, or suitability of the fitness plans or associated information.

Modification of Plans
We reserve the right to update, modify, or discontinue any aspect of the fitness plans, including exercises, schedules, or content, without prior notice.

 

User Accounts

When creating an account with us, you must ensure that all information provided is accurate, complete, and current. Failure to comply may result in the immediate termination of your account.

  • You are responsible for safeguarding your account password and for all activities under your account.
  • You must not share your password with any third party. If you suspect unauthorised access to your account, you must notify us immediately.

Account usernames must not:

  1. Impersonate any individual or entity.
  2. Violate any legal rights, trademarks, or intellectual property.
  3. Be offensive, vulgar, or obscene.

We reserve the right to suspend or terminate accounts that breach these terms.

 

Copyright Policy

We respect intellectual property rights and will address claims of copyright infringement. To report an infringement, please email [email protected] with the following details:

  1. A description of the copyrighted work and the material claimed to infringe.
  2. The location (URL) of the infringing material.
  3. Your contact details (name, address, email).

We will review and, if necessary, remove the infringing content.

 

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
